Flink Smith’s experience in closing residential and commercial properties and loans stems from representation of parties from each of the “four corners” of the closing table.  In particular, the representation of individuals and small businesses in their real estate transactions has been a bulwark of the firm since its inception, and a significant part of the firm’s founders’ practices from the moment they both started as young lawyers in established firms.  Both Jay Smith and Ed Flink have also represented lenders throughout their legal careers.  The success of our real estate operation is no coincidence. 

We are approved closers for over 45 mortgage lending and banking institutions, many of which are housed outside of the State of New York.  Additionally, we act as closing counsel for a number of mortgage brokers in the Capital District and in other areas throughout the State of New York. 

Our personal representation of sellers and buyers in real estate transactions comes with unparalleled service.  We currently have three full time real estate paralegals in the Latham office, and an experienced real estate paralegal in our Lake Placid office.  Our understanding of the loan process gives us a unique perspective through which we may advise individual and corporate clients through the escrow closing process.

In addition to our transactional expertise, we have an active real estate litigation practice, which is often necessary to resolve clients’ matters.  Before litigation is pursued, typically as a last resort, the benefit of having seasoned trial attorneys on hand who understand the transactional process affords certain insight and clout necessary to avoid pitfalls which could otherwise complicate a smooth transaction.  That said, when litigation proves necessary, we have the experience to obtain the right result for our clients, usually sooner rather than later.  Our real property litigation experience includes boundary disputes, actions for specific performance, landlord/tenant matters, tax certiorari and eminent domain proceedings.
